1. Acceptance of Terms

By registering for or using OptiLynx or any associated Evinsys Inc. services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you may not use the Service.

2. Description of Service

Evinsys Inc. provides OptiLynx, an industrial monitoring and data-management platform (“SCADA Engine”), along with integrated alerting and notification services that deliver messages by SMS, email, or other channels to registered users based on system alarms or operational events.

3. Eligibility

Use of the Service is limited to authorized business clients and registered users who have entered into a valid license or service agreement with Evinsys Inc.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must promptly notify Evinsys Inc. of any unauthorized access or security breach.

5. System Alerts and Messaging

By providing your mobile number or email address, you authorize Evinsys Inc. to send system alerts, notifications, and other service-related messages through OptiLynx.

Standard carrier messaging or data rates may apply.

You may disable non-critical alerts through your user settings, but critical system or safety notifications cannot always be disabled.

6. Data Accuracy and Availability

Evinsys Inc. strives to ensure the accuracy and reliability of data and alerts. However, delays, delivery errors, or interruptions may occur.

The Service is provided on an “as-is” and “as-available” basis, without warranties of any kind, express or implied.

7. Intellectual Property

All software, documentation, designs, and related materials remain the exclusive property of Evinsys Inc. or its licensors.

You are granted a limited, non-exclusive, non-transferable right to use OptiLynx in accordance with these Terms and your license agreement.

8. Prohibited Use

You may not misuse the Service, attempt to reverse-engineer the software, disrupt system operations, or use the messaging system for spam, advertising, or unauthorized communications.

9. Limitation of Liability

To the maximum extent permitted by law, Evinsys Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use OptiLynx, including data loss or missed alerts, even if advised of such possibilities.

10. Indemnification

You agree to indemnify and hold harmless Evinsys Inc., its affiliates, officers, and employees from any claim or expense resulting from your misuse of OptiLynx or breach of these Terms.

11. Termination

Evinsys Inc. may suspend or terminate access to OptiLynx at its discretion, with or without notice, if your usage violates these Terms or endangers system integrity.

12. Governing Law

These Terms are governed by the laws of the State of Texas, USA.

For users in Canada or the European Union, any mandatory consumer or data-protection rights provided by local law remain unaffected.

13. Amendments

Evinsys Inc. may update these Terms by posting a revised version at www.evinsys.com/terms. Continued use of OptiLynx after updates constitutes acceptance of the new Terms.
